Performance and Maintenance

  Sprint agrees to maintain and repair inside wire and telephone jacks and to provide trouble isolation of customer-owned telephone and peripheral customer-owned equipment for business customers who are paying the monthly maintenance charge for each access line.

Inside Wire

  "Inside wire" means the telephone wire within your business and the wire located outside of your business to the point where it connects to the Network Interface Device (NID) or business facility. The NID and/or business protector equipment and any wiring on your property leading up to the NID/protector is owned by Sprint. Customer-owned telephone instruments and/or peripheral equipment such as modems, FAX machines, answering machines, or burglar alarms that may be connected to a telephone jack are not included in the definition of "inside wire."

LineGuard Service Benefits

 

LineGuard Service covers repair and replacement of any faulty inside wiring or jacks that result from standard wear and tear or deterioration by the elements. LineGuard will cover all extensions of the same access line located on contiguous property. In some instances, it may be necessary to relocate the inside wire during repair. For example, if it is determined that the trouble is in your inside wire that runs through your attic, repair of your inside wire may be handled by re-routing the wire rather than repairing the defective wire in the attic.

Non-Owner Occupied Realty

 

Customers who conduct business in a non-owned facility are responsible for contacting their landlord or owner. Sprint is not responsible for notifying the building owner.

Exclusions

  LineGuard does not cover damage to your inside wire and jacks that is the result of fire or acts of God like hurricanes, tornadoes, earthquakes, and/or flooding that may destroy the premises or cause irreparable damage. You should consult your insurance carrier for potential coverage of damage from these causes.
    LineGuard service excludes inside wire and jacks in boats, tents, trailers, recreation vehicles, and any temporarily located vehicles.
    LineGuard service excludes the maintenance and repair of inside wire, which does not meet Sprint's technical standards or installation guidelines. Wiring must be in working condition at the time LineGuard coverage is initiated.
    LineGuard excludes the activation and re-activation of jacks, relocation of jacks, replacement or installation of inside wire, or any current existing repair problems known but not reported at the time LineGuard coverage is initiated.
    LineGuard service excludes crosstalk between two lines on four-conductor non-twisted wire.
    LineGuard service excludes customer-owned telephone instruments, telecommunication peripheral equipment (e.g., external bells, answering machines, etc.) and telephone cords between the telephone instrument, equipment, jack or other connections on the premises. LineGuard service excludes the coverage of Category five cable.

Burglar Alarm Systems

  When a Sprint technician isolates the trouble to the customer's burglar alarm system, the customer will be advised that the burglar alarm system is the cause of their access line service problem and that the alarm has been disconnected in order to restore the access line service. It is the customer's responsibility to immediately have the burglar alarm repaired. Sprint will not be liable for any damages resulting from the alarm being disconnected.
    If within a thirty-day period, this same customer reports access line trouble and a Sprint technician isolates the trouble to the customer's burglar alarm system, the technician will determine whether or not the customer has taken the initiative to have the alarm system repaired before the alarm system was reconnected to the telephone access line and will determine whether a trouble isolation charge will be assessed against the customer.

Payment and Changes in Terms and Conditions

  LineGuard will be billed at Sprint's current rate of $3.95 per month. Sprint may elect to change the terms and conditions, including the price, under which LineGuard is provided. You will be notified in advance of any changes. If you elect to cancel LineGuard under the changed terms and conditions, it is your responsibility to notify Sprint.

Limitations of Remedies and Liabilities

  Sprint's liability to the customer for damages, regardless of the form of action, shall not exceed the lesser of: a) actual damages which are proven, or b) two years' charges for LineGuard. Sprint shall not be liable in any way for delay, failure in performance, loss or damage due to any cause beyond its reasonable control. SPRINT SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, AND LOSS DAMAGE OR EXPENSE DIRECTLY ARISING FROM THE CUSTOMER'S USE OF OR INABILITY TO USE THE INSTALLED OR REPAIRED PREMISE WIRING, EITHER SEPARATELY OR IN COMBINATION WITH OTHER EQUIPMENT.
    This agreement shall remain in effect for as long as LineGuard is offered by Sprint and as long as you pay the charges for the service, or until you advise Sprint to discontinue the service.
    These terms and conditions shall be interpreted under the laws of the state where the Sprint customer receives service. Orders for LineGuard may be taken over the telephone.
    SPRINT DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Data LineGuard Terms and Conditions

Data LineGuard will be billed at Sprint's current rate of $5.45 per month. Sprint may elect to change the terms and conditions, including the price, under which Data LineGuard is provided. You will be notified in advance of any changes. If you elect to cancel Data LineGuard under the changed terms and conditions, it is your responsibility to notify Sprint.
